Terms of Service

Welcome to DataWhisperer. These Terms of Service ("Terms") are a binding agreement between you and DataWhisperer LLC, a Georgia limited liability company ("DataWhisperer", "we", "us", "our"). These Terms govern your use of the DataWhisperer website at datawhisperer.co and any related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What DataWhisperer does

DataWhisperer is a web app that lets you upload files (CSV, Excel, TSV, or TXT), get Briefs with a headline and supporting figures, use Ask for questions about your data, request computed Tables for supported breakdowns, and run supported exploratory Stats tests on eligible plans. The data-quality view checks your file without editing it. The Service is delivered entirely online — there are no physical goods.

DataWhisperer is decision support, not decision-making. Some results use AI to interpret your request and explain figures computed from the file. AI output can still be wrong or incomplete — you, not DataWhisperer, make the call. See Section 5 and Section 9a for the full AI and decision-analysis disclaimers.

2. Your account

To analyze your own data, create an account without a payment method. The Free plan includes a monthly allowance of Briefs and Asks, and paid plans (which begin with a 7-day free trial — see Section 3) add more. You're responsible for keeping your login credentials safe and for everything that happens under your account. You must be at least 16 years old, and if you're using DataWhisperer on behalf of a company, you confirm you're authorized to bind that company to these Terms.

3. Plans, billing, and refunds

The Free plan lets you use the Service on your own data (Briefs and Asks, 5 uses per month) at no cost and without a payment method. Paid plans ("Pro", "Max") begin with a one-time 7-day free trial: a payment method is collected at checkout, but you are charged $0 during the trial. If you cancel before the trial ends, you are never charged and your account returns to the Free plan. If you do not cancel, the trial automatically converts to a paid subscription at the then-current price for the plan you chose ($49/month for Pro or $99/month for Max at the time of writing). The free trial is limited to one per customer. Each paid plan includes a monthly usage allowance — each output the Service produces (a Brief, an Ask answer, a computed Table, or a Stats run) uses one; the pool refreshes each billing period, and Pro and Max users can buy a non-expiring 20-use top-up for $15. Top-ups add usage, not features. Higher plans include larger pools and additional features (such as larger files and Python snippets for supported results). Current prices, monthly usage amounts, and file-size limits for each plan are shown on our pricing page and at checkout.
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.
Subscriptions renew automatically each billing period until cancelled. You can cancel anytime from Settings → Account inside the app — cancellation takes effect at the end of your current billing period and you keep access until then.
No refunds, cancel anytime. We don't issue refunds for partial or unused billing periods. If something is genuinely broken on our end, contact us and we'll make it right.
If a payment fails, we may downgrade or suspend your access until the issue is resolved.
We may change pricing for future billing periods. We'll let you know in advance via the app or email if you've given us one.

4. Your data

You retain ownership of the data you upload ("Your Data"). You grant us a limited license to store, process, and analyze Your Data only so we can provide the Service to you.
We don't sell Your Data, and we don't use Your Data to train AI models.
You're responsible for making sure you have the right to upload Your Data and that doing so doesn't violate any law, contract, or other person's rights (including privacy laws).
Don't upload sensitive personal data — including medical records, payment card numbers, or government IDs.
When you delete a file, we delete the underlying file and its derived insights from our active systems. Backup copies and records required for billing, security or legal obligations may remain as described in our Privacy Policy; no fixed backup deletion window is promised here.

5. AI-generated output

DataWhisperer uses third-party large language models (currently OpenAI) to generate briefs and answer Ask questions on Your Data. AI output can be wrong, incomplete, misleading, or out of date, even when it cites numbers from your file. You are responsible for reviewing AI output — including the cited figures — before relying on it for any decision, sharing it externally, or acting on it. We make no guarantee that AI output is accurate, complete, or fit for any particular purpose.

Outputs are designed to cite the underlying numbers from your file so you can verify them — but that design reduces, and does not eliminate, the chance of output that is wrong, ungrounded, or unsafe. Certain categories of decisions are prohibited and require a qualified professional, not this Service — see Section 9a. If you encounter output that looks wrong or unsafe, please report it via Feedback or a support ticket.

You may use AI output generated from Your Data freely (for internal decisions, briefings, presentations, etc.), subject to the disclaimers above and Section 9a.

6. Acceptable use

You agree not to:

Use the Service for anything illegal, harmful, deceptive, or that infringes someone's rights.
Try to break, overload, or reverse-engineer the Service or its underlying systems.
Scrape the Service, abuse rate limits, or use automated tools to extract data from it. AI features draw from your plan's monthly usage (shown on the pricing page), which resets automatically each billing cycle; we also apply burst rate limits to prevent automated abuse.
Resell or sublicense the Service without our written permission.
Upload malware, viruses, or anything intended to disrupt the Service or other users.
Use the Service to build a directly competing AI data-analysis product.

We may suspend or terminate accounts that violate these rules, with or without notice.

7. Service availability and changes

We work hard to keep the Service running, but we don't guarantee uptime. The Service is provided "as is" and "as available". We may add, change, or remove features at any time. If a change is material and affects your paid plan, we'll let you know.

8. Our intellectual property

DataWhisperer, including the website, branding, and underlying software, is our property and is protected by intellectual property laws. These Terms don't transfer any of our IP rights to you except the limited license to use the Service while your account is active.

9. Disclaimers

Please read this carefully.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI OUTPUT WILL BE ACCURATE OR RELIABLE.

9a. Decision support, not decision-making

DataWhisperer is decision support, not decision-making. The Service surfaces what your file shows — headline findings, answers to your questions, and computed breakdowns of your numbers — through Briefs, Ask answers, and Tables and supported Stats. It does not, and is not intended to, tell you what to do. It does not provide financial, legal, tax, medical, investment, employment, accounting, or other professional advice, and it is not a substitute for a qualified professional in any of those fields. Any decision you make is your own. You are solely responsible for the actions you take based on Service output, including but not limited to decisions informed by Briefs, Ask answers, and Tables.

Some plans display the analysis steps behind an answer as generated computer code (for example, Python). That code is AI-generated output like any other part of the Service: it is provided "as is" for transparency, may contain errors, and is not warranted to be correct, complete, or safe to run. Review it before executing it in any environment; you run it at your own risk.

You must not use the Service to make or inform certain categories of decisions: decisions about named individuals (hiring, firing, discipline, or compensation tied to named people), clinical or medical decisions, and active or contemplated legal matters. These categories require a qualified human professional — not an automated tool — and any output the Service may produce touching on them is not advice and must not be relied on.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAWHISPERER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.

11. Indemnification

You agree to defend and indemnify DataWhisperer against any third-party claim arising from Your Data, your violation of these Terms, or your misuse of the Service.

12. Termination

You can cancel your account at any time from Settings → Account. We can suspend or terminate your account if you violate these Terms or if we stop offering the Service. On termination, your right to use the Service ends and we may delete Your Data after a reasonable wind-down period.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date at the top and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts.
